Terms of Service

The Basics Terms of Service:

Process:
After reviewing the proposed project from the client, The Basics will put forth an estimated cost for the project and an estimated time-frame for the project. This time frame will include a completed time and a rough draft presentation time.

The Basics reserves the right to charge extra for extra services if these services are not brought forth thoroughly during the project review.

Rough Drafts:
Rough drafts are simply rough drafts. They are by no means the final design/layout of the site. They are designed to simply give the client a feel for what the site could look like. The rough draft is created using the information that the client provides prior to starting the project. The more information the client provides, the better the client will most likely like their rough draft.

The rough draft will include as much functionality as possible (if the project is an ecommerce or similar site) but complete functionality cannot be guaranteed. This is only the rough draft and is meant only to give the client something to see and for The Basics to build off of.

After the rough draft has been completed, no refunds will be given.

Re-Design:
Once a rough draft has been presented and the client has begun requesting changes, the client must stick with that basic design. Changes include change of colors/fonts/sizes, pictures being swapped out, etc. Changes do not include a total re-design of the site. To make this more understandable, after 5 hours of revisions to the rough draft, the client can no longer request a total redesign. They are still entitled to, however, unlimited revisions.

If a total re-design is necessary, one can be requested for a minimum of $100 or as agreed upon.

Extra Charges:
If a project exceeds what was agreed upon between The Basics and the client, or The Basics feels as if the client has not come forth will all the requirements for the project, The Basics reserves the right to charge additional fees, paid upon completion of site or as agreed upon between The Basics and the client.

Out Sourcing:
The Basics reserves the right to outsource work or projects. The Basics may outsource difficult or technical projects to a foreign or third-party company or individual. The Basics may do this without informing the client. Outsourcing ensures that the client will receive a thorough project within budget.

Collection of Fees:
A 50% down payment is required before any work is done on any project. After The Basics and the client have decided on the terms for the site, a 50% payment must be collected. After the site has been finished and tested, the remaining balance will be paid before The Basics transfers the project to the clients server.

If for some reason payment is not collected before the transfer of the project to the clients server, The Basics reserves the right to repossess any/all work that The Basics has performed regardless of how much/little remaining balance is due.

If a project is started and a partial payment is made and no communication is made from the client for more than 90 days, the project will be terminated without any refund.

Late Payments:
Late payments will result in a 10% or $20 charge, whichever is higher, on top of the remaining balance owed. This amount will increment every two weeks payments are late.

Copy Rights:
The Basics reserves a copy of each site to do as they please. The Basics may re-use code snippets or even whole pages/scripts. The Basics will not re-use personal text, print or graphics. If the client provided The Basics with any type of media, this media will stay unique to only the client. The Basics is simply reserving the rights to the code and any graphics The Basics develops or creates.

Settlements:
Any disputes will take place in an arbitration court within the state of Washington.
